Amazon and OSHA Reach Broad Settlement Over Injury Rates and Warehouse Working Conditions

In a significant development in the ongoing debate over worker safety in Amazon’s warehouses, the e-commerce giant has reached a broad settlement with the Occupational Safety and Health Administration (OSHA) regarding allegations of hazardous working conditions. The agreement addresses several key issues, including:

Implementation of a Dispute Resolution Process for Ergonomics Complaints

As part of the settlement, Amazon will establish a dispute resolution process to address ergonomics complaints from workers. This process aims to ensure that employees’ concerns are heard and addressed promptly.

Regular Meetings to Review Injury Data

Amazon has agreed to hold twice-yearly meetings with OSHA to review injury data and assess progress in addressing worker safety issues. These meetings will enable both parties to monitor trends, identify areas for improvement, and make adjustments as needed.

Penalty and Commitment to Compliance

The company will pay a penalty of $145,000, which represents more than 90% of the fines levied by OSHA in its citations. This settlement also requires Amazon to take action at the corporate level to ensure ergonomics requirements are effectively implemented across all facilities.

Amazon’s Response

Amazon has described this provision as a continuation of its existing practices, stating that it will continue leveraging its corporate team of certified ergonomists to ensure compliance across all sites in the network. The company cited factors including:

  • A 28% improvement in its recordable incident rate since 2019
  • A 27% improvement in ergonomic injury rates
  • A 75% improvement in lost-time injury rates

Amazon noted that there isn’t a claim of wrongdoing on their part for the withdrawn citations, nor a directive to adopt new safety controls.

The Senate Committee Report

The settlement follows the release of a 160-page report from the Senate Committee on Health, Education, Labor, and Pensions (HELP), led by Sen. Bernie Sanders. The report alleged that Amazon manipulated injury data, disregarded internal safety research, and discouraged injured employees from seeking external medical care.

Amazon previously called this report "wrong on the facts," stating that it "weaves together out-of-date documents and unverifiable anecdotes to create a pre-conceived narrative" from Sanders and his allies.

Strategic Organizing Center’s Response

The Strategic Organizing Center, a coalition of labor unions, criticized Amazon’s statements about the OSHA settlement in a statement on Thursday afternoon. The executive director stated that Amazon’s claim that this settlement vindicates its years of misleading the public about the safety of its warehouses is absolutely false.
